ORDINANCE To Declare a Temporary Moratorium on Mini-Warehouses and Self-Storage Facilities.
WHEREAS, the City of Prattville currently has numerous Mini-Warehouses and Self-Storage Facilities throughout the City, which provide its citizens with a wide variety of storage options; and
WHEREAS, cities that are in close proximity to the City of Prattville have experienced a proliferation of businesses that are licensed and authorized to operate, among other things under the Alabama Self-Service Storage Act, §8-15-30 through §8-15-38, Code of Alabama, 1975, as amended; and
WHEREAS, the City Council finds that the overdevelopment of Mini-Warehouses and Self-Storage Facilities within the Corporate Limits of the City of Prattville would be detrimental to the City’s development and effectively limit the ability of the City to attract diverse types of businesses, and that it is in the best interest of the overall economic development to provide for the orderly growth and balance of the development of these businesses in order to have a diverse and stable economy; and
WHEREAS, there is a need for the City to review its existing zoning ordinance to make necessary adjustments and improvements as to these types of business establishments; and
WHEREAS, the City is in the process of hiring a Planning and Development Director to further review the zoning ordinance and address the issue of Mini-Warehouses and Self-Storage Facilities; and
WHEREAS, these businesses are classified by the following License Codes pursuant to Section 38-321 of the City of Prattville Code of Ordinances:
5317297 Mini Warehouse C; and;
WHEREAS, the City Council desires to temporarily pause the issuance of permits and approvals for Mini-Warehouses and Self-Storage Facilities until the zoning ordinance can be reviewed and adjusted; and
WHEREAS, a temporary moratorium on the issuance of permits, business licenses, and other approvals for such Mini-Warehouses and Self-Storage Facilities will create a stable environment so that revisions to the City’s zoning ordinances can be considered and adopted in an orderly and thorough process.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Prattville that in order to protect the public health, safety, and welfare of its residents, it is in the best interest of the City to declare a temporary moratorium on the issuance of permits or other approvals for any Mini-Warehouses and Self-Storage Facilities, in order for the City to complete its review of the zoning ordinance as to these establishments.
BE IT FURTHER ORDAINED that this moratorium shall be effective upon passage and publication and shall continue through June 16, 2026, unless terminated or extended by action of the City Council.
BE IT FURTHER ORDAINED that establishments which have received an approved building permit and business license prior to the effective date of this ordinance may proceed as allowed by the terms of the permit and applicable rules and regulations, and will be excepted from the terms of this Ordinance.
THE provisions of this Ordinance are severable. If any portion of this Ordinance is declared invalid or unconstitutional, such declaration shall not affect the parts which remain.
